By attending, participating in, or exhibiting at Kooks at the Kruise (the “Event”), you agree to the following:
1. Assumption of Risk
Participation in this Event includes inherent risks, including but not limited to:
- Vehicle operation, demonstrations, and burnouts
- Mechanical failure or loss of vehicle control
- Slips, trips, and falls
- Weather conditions
- Use of recreational equipment, including inflatable/bounce houses
- Interaction with other attendees and vehicles
By attending, you voluntarily assume all risks associated with the Event.
2. Release of Liability
To the fullest extent permitted by law, you release and hold harmless:
Kooks Headers & Exhaust, Kooks at the Kruise, event organizers, sponsors, staff, volunteers, and affiliates
from any and all liability for:
- Personal injury or death
- Vehicle damage or destruction
- Property damage, theft, or loss
including incidents resulting from burnouts, vehicle demonstrations, or event activities, whether caused by negligence or otherwise.
3. Vehicle Damage Disclaimer
Kooks Headers & Exhaust and Event organizers are not responsible for any damage to vehicles, including but not limited to:
- Accidents during entry, exit, or while parked
- Damage from other participants or spectators
- Mechanical failure or misuse
- Damage resulting from burnouts or demonstrations
All vehicle owners assume full responsibility for any damage to their vehicle and any damage caused by their vehicle.
4. Burnout Policy
Burnouts are permitted only under the following conditions:
- Burnouts must occur only in designated areas
- Participants assume all risk for injury, vehicle damage, or damage caused to others
Kooks Headers & Exhaust is not liable for any consequences related to burnout participation.
5. No Responsibility for Lost or Stolen Items
Event organizers are not responsible for lost, stolen, or damaged property, including vehicles, personal belongings, or vendor items.
6. Bounce House / Recreational Activities
The Event may include a bounce house or similar attractions.
- Use is at your own risk
- Parents/guardians are solely responsible for supervising children
- Kooks Headers & Exhaust assumes no liability for injuries related to inflatable or recreational equipment
7. Vehicle Operation & Conduct
All drivers must:
- Operate vehicles safely and responsibly
- Follow staff instructions and event rules
- Comply with all applicable laws
Unsafe behavior outside designated areas may result in removal from the Event.
8. Medical Responsibility
Participants are responsible for their own medical care and insurance.
Event staff may seek emergency assistance if necessary but assume no liability.
9. Indemnification
You agree to indemnify and hold harmless Kooks Headers & Exhaust and all Event affiliates from any claims, damages, or expenses arising from your participation.
10. Media Release
By attending, you grant permission for use of your image, likeness, and vehicle in photos/videos for promotional purposes without compensation.
11. Agreement
By entering the Event, registering, or participating, you acknowledge that you:
- Have read and understood this waiver
- Voluntarily agree to all terms
